Programs that provide assistance for people who are unable to make their mortgage payments and at risk of losing their homes through foreclosure or who are already in the foreclosure process. Services may include information about the foreclosure process, legal timelines and how to contact and negotiate with a lender; assessment of the homeowner's financial situation and development of a plan to address homeownership and financial issues; in-depth financial counseling regarding foreclosure avoidance options and/or options that involve leaving the home; advocacy with lenders, when necessary; and referrals to foreclosure prevention resources. Predatory lending tactics include high pressure sales techniques; misleading or fraudulent direct mail campaigns; failure to disclose unusually high interest rates, hidden transaction costs, excessive fees and punitive penalty clauses such as balloon payments; and loan agreements that are based on home equity rather than a realistic ability to repay. Predatory lenders frequently target the most vulnerable consumers including older adults, low-income individuals, minorities who are struggling financially, and people residing in communities underserved by traditional banking institutions.

Predatory Lending Awareness Programs

Programs that help people who want to purchase a home evaluate their readiness for homeownership, shop for housing that meets their needs, resolve potential credit problems, analyze specific home purchase offers, obtain a mortgage loan with advantageous interest rates and an affordable monthly payment, and complete the paperwork to close the loan and complete the sale. Also included are programs that provide assistance for people who want to refinance a home.

Homebuyer/Home Purchase Counseling

Programs that help people who are having difficulty paying their monthly bills gain control of their finances. The process generally involves analysis of the individual's income, expenses, debts, taxes and other factors to create a personal financial assessment; development of a budget for basic living expenses; and agreement on a short-term plan for repayment of creditors which may include debt consolidation or other strategies and a longer term plan for realizing personal financial goals.

Personal Financial Counseling

Programs that provide assistance for people who are unable to pay their creditors and need to declare bankruptcy. Included may be help in evaluating a personal or business bankruptcy as an option, assistance in completing and filing bankruptcy forms and/or representation in bankruptcy hearings.

Bankruptcy Assistance

Programs that make an arrangement which allows older adults who have equity in their homes to obtain cash from their homes without selling them in order to pay for home health care and other needed services and avoid institutionalization (or to use for other purposes). The individual may either obtain a reverse annuity mortgage which provides an annual income for the individual and may also include a lifetime tenancy, or sell and lease back his/her home on a basis that guarantees lifetime tenancy. The institution providing the annuity receives title to the house or cash from the sale only when the older person dies or moves away.  In the sale-leaseback arrangement, the title to the house is transferred to the lender immediately. Most of these programs provide counseling regarding the general benefits of reverse mortgages, and some may evaluate an individual's personal financial situation and recommend a reverse mortgage if it would be to the person's advantage.
