We are located on the Olympic Peninsula in Washington State. Our Native American reservation is in the town of Neah Bay and includes the most northwest point of the continental United States. Across the Strait of Juan de Fuca you can see Vancouver Island in Canada. Near our village, we have Cape Flattery, Shi Shi, and miles of beach.

Independent courts that have been established to serve the legal needs of Native American tribal members who reside on tribal reservations. The courts are as varied as the tribes themselves and adhere to laws and procedures from tradition-based systems with little or no written rules or codes to systems that mirror courts in the federal and state systems. The jurisdiction of tribal courts also varies. Some may have jurisdiction only over certain types of crimes committed in the community (e.g., misdemeanors) while the state or federal courts have jurisdiction over other cases. Other tribal courts may take jurisdiction only over crimes committed by adults and refer juvenile offenders to non-Native American courts.

Organizations that support the passage and enforcement of laws and other social measures that protect and promote the rights and interests of one or more specific ethnic groups.

Ethnic Advocacy Groups

Programs that provide assistance for Native Americans who need legal advice or representation regarding federal recognition, treaty rights, fishing and hunting rights, environmental protection, reservation boundaries, land acquisition, land and water rights, Native American gaming, housing, health, taxation or jurisdictional questions. Attorneys who practice in this area are concerned with the treaties, statutes, executive orders, court decisions and administrative actions that define the relationship among the United States, Native American tribes and individuals, and the states. Native American law attorneys are found in federal government bodies such as the Bureau of Indian Affairs and The Indian Claims Commission, which hears and determines claims against the United States on behalf of any Native American tribe. Private law firms also have lawyers who specialize in matters relating to Native American lands and reservations, tribal rights and other legal issues affecting Native Americans. Specific Native American tribes, which are recognized as sovereign entities with the power to regulate their internal and social organization, have lawyers who may be members of the tribe themselves, and/or lawyers who are hired as "general counsel" to handle the legal affairs of their tribe. Public service agencies also serve the Native American community with lawyers who specialize in the Indian Child Welfare Act, and others who serve children, people who are elderly, or indigent members of the Native American community.

Native American/Tribal Law

Tribal agencies that are responsible for enforcing the laws established by the tribe's constitution, protecting persons and property within the tribal jurisdiction, ensuring that orders of the tribal court, where one exists, are properly carried out, and providing security for General Council meetings, tribal elections, dances or other tribal events. Tribal police work for the local tribe and are not directly overseen by the Bureau of Indian Affairs, and may share jurisdiction with the state police or marshal's office. Tribal police may, for example, have jurisdiction only for crimes committed by and against Native Americans in the community whereas state police retain jurisdiction where non-Native Americans commit crimes on the reservation.

Programs that maintain and, where appropriate, provide access to the official documentation which contains the names of individuals who belong to one of the recognized groups of Native Americans that constitute a tribe. Also included are programs that help Native Americans complete and file the paperwork that is required to establish tribal membership.

Native American General Assistance

Programs that provide opportunities for people of all ages to learn, become competitive in and enjoy the organized recreational activity, sport or game of their choice. These programs may be offered by local clubs devoted to a particular activity or sport; may provide individual or team coaching assistance or instruction, access to equipment and facilities, and uniforms, if necessary; and may sponsor or make arrangements for athletes to participate in amateur competitions, usually at the local, regional or state level, and provide officials for games. These events are generally for the enjoyment of the athletes and are not at a high enough competitive level to be considered spectator sports.

State trial courts of general jurisdiction that handle civil cases which involve personal injury, property damage or liability, medical or dental malpractice, real estate actions, equity suits such as injunction proceedings, specific performance contract disputes, administration of trusts and foreclosure on mortgages; and, in jurisdictions where there are no specialized courts, adoptions, probate, family law and psychiatric cases. In some states, a distinction is made between municipal civil courts which hear cases involving monetary claims lower than an established amount and superior civil courts which hear all other civil cases. The type of cases handled by civil trial courts varies by state.

Civil State Trial Courts

State courts which have exclusive jurisdiction in most civil actions against the state and over claims removed from other courts to the Court of Claims. State Courts of Claims are only available in a few states.

State Court of Claims

A state trial court of original jurisdiction that tries and adjudicates controversies involving deficiencies or overpayments of taxes covered by state tax law which may include personal income tax, property tax, corporate excise tax, timber tax (where relevant), local budget law and property tax limitations. It is the responsibility of the Tax Court to provide expeditious, convenient, equitable and effective judicial review of state and local tax assessments; create a consistent, uniform body of tax law for the guidance of taxpayers and tax administrators that promotes predictability in tax law and its application; and make decisions of the court readily available to taxpayers, tax administrators and tax professionals. In some jurisdictions, the Tax Court may also hear appeals of inheritance tax determinations from the courts of probate jurisdiction.

State Tax Court

Intermediate appellate courts that, in most states, hear appeals from cases decided in state trial courts. In states with this court structure, decisions by the State Courts of Appeal may be reviewed by the State Supreme Court at its discretion.

State Court of Appeals

State trial courts that handle infractions punishable by a fine; misdemeanor cases such as petty theft, prostitution, intoxication and vandalism punishable by a fine with a maximum level (usually $1000) and maximum amount of time in county jail (usually a year or less); and felony cases such as murder, possession of dangerous drugs for sale, robbery and rape that are punishable by a state prison term or, in states where capital punishment is legal, by death. In some states a distinction is made between municipal criminal courts which handle infractions, misdemeanors and preliminary hearings for felony cases; and superior criminal courts which try felony cases and misdemeanor cases for which other provisions have not been made. The type of cases handled by criminal trial courts varies by state.
